Accommodation conditions and intermediation conditions

The administration of the health resort  “Bade- und Kurverwaltung Bad Bellingen GmbH”, hereinafter referred to as Buk, solely acts as an intermediary for accommodation establishments, hereinafter referred to as accommodation provider. Intermediating accommodation possibilities does not constitute any contract under the travel agreement law and does not relate to the new regulation of the law on package travel as from 01.07.2018. No contractual relationship is created between BuK and the guest, but exclusively with the accommodation provider.

Unless otherwise agreed between the accommodation provider and the renter, the following conditions shall apply: Please read these conditions carefully.

Accommodation and lodging contract

The lodging contract is concluded when booking and accepting the accommodation.
Not only a verbal but also a written form are binding regarding the confirmation. A conclusion of a lodging contract obliges the contract partners to fulfil the contract, no matter for which duration it is concluded.

Services and prices

The indicated prices are final prices plus tourist tax. Any additional services require a written confirmation. Important: The offer you received from your accommodation provider is binding even if its details deviate from the details provided in the brochure. A service can be offered to the guest either by the administration of the health resort (when booking a package travel) or by the accommodation provider.

Cancellation and no-show

In case of non-utilization of the contractual services, the guest is obliged to pay the agreed or customary price less any expenses saved by the accommodation provider. The savings, recognised by case-law are the following percentages:

The accommodation provider is obliged in good faith and trust to pay damages to the guest if the booked room is not available. The accommodation provider has to make efforts within the framework of his business operations to let unused rooms to other persons if possible to avoid any losses. The guest has to pay the calculated price for the duration of the contract up to the time where the rooms/holiday flat are let otherwise. To avoid any undesired compensation payments we recommend to our guests to conclude a travel cancellation insurance before starting the journey.

Payment

The due dates of the down payment and the residual payment depend on the regulation agreed with the guest or the customer which are indicated in the booking confirmation. If no special stipulation has been agreed, the whole accommodation prices including any additional services are due at the end of the stay and have to be paid to the accommodation provider. For stays lasting for more than one week, the accommodation provider can at its expiry invoice the remuneration for preceding days of stay and for any additional services (for example food which is not included in board service, drinks taken from the minibar).

Provisions of the BGB (German Civil Code)

In all other respects the provisions of the BGB shall apply for the contractual relationship and for the accommodation provider’s liability for any items brought.
